Baloch student recovery; The problems of missing persons are not creating love for the state, Justice Mohsin
Islamabad: In the case of Baloch student recovery, Justice Mohsin Akhtar Kayani of Islamabad High Court remarked that these issues of missing persons are not creating love for the state, they do not know that such actions create hatred against the state.
In the Islamabad High Court, the case of implementation of the recommendations of the commission regarding the recovery of Baloch students was heard. Justice Mohsin Akhtar Kayani heard the case, the petitioner Advocate Iman Mazari and Stunt Attorney General appeared before the court.
Justice Mohsin Akhtar Kayani inquired that the ISI, MI, IB, CTD, FIA committee was formed, has the secret agencies committee done any work? The Assistant Attorney General requested that if the court gives time after Eid, upon which Justice Mohsin remarked that those who are missing should also observe Eid.
Additional Attorney General Manoor Iqbal Dogal also appeared before the court during the hearing.
Lawyer Iman Mazari said that I want to highlight that there is another statement that something else happens in Balochistan, one student Anisur Rahman is still missing and the rest of the students have been recovered.
Justice Mohsin Akhtar Kayani remarked that now the issue of long-term missing is taking the form of short-term missing, someone asked the policy makers at some level, they are not realizing how hatred is increasing, among them. Of course there will be terrorists but whatever has to happen has to be according to the law.
Lawyer Iman Mazari said that first they go missing and then they hand over to CTD, now this matter is increasing in the whole country. Justice Mohsin Akhtar Kayani remarked that the courts also lack that we only focus on recovery, for every action there is a reaction, they do not know that such actions create hatred against the state. Still only focused on recovery of missing persons, we never went beyond that.
The Additional Attorney General argued that as the attorney had done, progress has been made regarding the missing persons, a committee consisting of members of secret agencies and the chairman has been formed.
The court inquired that the Attorney General was told about the cases of three missing persons at the last hearing, what happened to it? The Additional Attorney General replied that 91 out of 95 have been traced so far, we have done our best, no malice involved.
Justice Mohsin Kayani remarked that this is not a case of malice, it is a case against a state institution. Has the committee been formed? Only notification now? We have also allowed changes in the composition of the committee on the request of the Attorney General, we have referred the matter to a larger bench for missing persons cases, the Criminal Justice Committee also has a meeting where we look at the issues. , it also called for the DGs of ISI, MI and IB.
Justice Mohsin Akhtar Kayani remarked that a committee is on the administration side, it will call the heads of secret agencies, they will brief only the extent of missing persons, many cases are related to national security, we will do them in camera. Give us an in-camera briefing on missing persons. This issue of missing persons should be resolved. These missing persons issues are not creating love for the state. After that, we will not tell you, direct them. Will call and ask.
Justice Mohsin said in his remarks that the agencies have their own work, they are not being stopped from their work, if a man is kept by the agencies and later CTD has to plant 500 grams of explosive material, then only the courts can do it. Time is wasted. At the international level, we are recognized as human rights violations, that’s why investors are not coming here, the courts don’t get frustrated and close the case, they give a decision, the institutions are being blamed. They have to perform and disprove the allegation, 91 out of 95 people were traced, yet we have not called them and recorded their statements.
The court pointed to Advocate Iman Mazari and remarked that I can see that this girl is standing on behalf of the entire Pakistan, 91 out of 95 people were recovered missing on the day their statements will be recorded by half of your government. Officials will be prosecuted.
Justice Mohsin Akhtar Kayani remarked that the families of the missing persons are waiting for their children, he will pass a detailed order in this regard.
The court adjourned further hearing of the case
